EU and Competition Law

LETT has extensive experience in advising businesses on all aspects of Danish and EU competition rules. We offer qualified sparring services to managements as regards optimising the operations of businesses while complying with competition rules and we target our advice to ensure that the business obtains what is, from a commercial point of view, the optimum solution.

 
LETT wants to ensure our clients’ optimum competitive behaviour. Consequently, one of our primary functions is to provide advice on how to avoid competition problems.
 
LETT provides advice on drafting commercial contracts of any kind in compliance with competition rules for the purpose of avoiding illegal anti-competitive effects. We provide advice on the possibilities for businesses of concluding certain anti-competitive agreements within the legislative framework by applying for specific exemptions or by benefiting from the special block exemption rules applying.
 
LETT provides advice on formulating business policies for businesses enjoying high market shares while avoiding any anti-competitive effects, e.g. as regards price and discount structures or the choice of trading partners, as businesses enjoying dominance over a market area are subject to special restrictions as to their market conduct.
LETT prepares internal compliance programmes regarding competition rules specifically designed for each individual business and assists in instructing relevant staff groups of the business.
 
The powers of the Danish competition authorities and the European Commission are extensive when it comes to investigating any non-compliance with competition legislation by businesses and increasingly, the authorities resort to unannounced inspections. In the event of a ”dawn raid”, a business needs to respond rapidly. LETT is able instantly to provide a team of highly qualified lawyers experienced in competition law to assist in safeguarding the interests of the business during a dawn raid. Given our offices in Copenhagen, Aarhus and Kolding, LETT is able to guarantee standby teams to assist the administration of a business almost anywhere in Denmark.
 
LETT provides advice on competition rules in connection with acquisitions, mergers and joint ventures and assists in notification to as well as ”clearance” by the competition authorities, including any informal or formal advance discussions.
 

LETT conducts cases before the Danish courts and the European Court of Justice, i.a. in connection with complaints as well as actions for damages in the event of any inconvenience suffered or loss incurred by a business as a result of illegal anti-competitive agreements or as a result of any illegal market conduct on the part of dominant entities.
