Litigation and arbitration

Litigation ranges among LETT’s core practice areas. For a number of years, LETT has specialised in conducting court and arbitration proceedings and i.a. renowned international legal market guides recommend LETT as a top-of-the-line law firm in Denmark within this field.
 
We assist our clients in assessing whether and where conflicts are likely to arise and based on each client’s specific situation, we provide advice on how best to safeguard its interests – including as regards preservation or taking of evidence. We take part in negotiations if a conflict seems likely or has already arisen and if no solution is found, we conduct legal proceedings before the courts or an arbitration tribunal.
 
Most of the partners in LETT have rights of audience before the Danish Supreme Court. Many are also members of Højesteretsskranken, which is a Danish association of supreme court litigators reserved for attorneys experienced in appearing before the Supreme Court.
 
In LETT’s opinion, conducting litigation and arbitration is a separate area of legal expertise. Consequently, LETT has formed a department consisting of attorneys highly experienced in conducting litigation and arbitration. The attorneys in this department specialise specifically in litigation and cooperate closely with the attorneys of LETT’s other departments in safeguarding our clients’ interests in connection with disputes within all LETT’s other areas of expertise.
 
LETT has long and extensive experience in representing Danish as well as foreign clients before all tiers of the Danish judicial system and in conducting cases before the European Court of Justice. Moreover, LETT continues to be involved in a substantial number of lawsuits before the High Courts as well as the Supreme Court.
 
Equally, we are widely experienced in assisting clients in Danish as well as international arbitration proceedings – both in institutional arbitration through e.g. the Danish Institute of Arbitration, the Danish Building and Construction Arbitration Board and the ICC and before ad hoc arbitration tribunals – and as a result, we have thorough knowledge of the specific rules of procedure applying to such proceedings.
 
In addition, LETT assists its clients in cases before a vast number of administrative appeals bodies, such as the Danish National Tax Tribunal, Revisornævnet (the Danish accounting practices board) and the Danish Company Appeals Board, etc.
 
Several of LETT’s attorneys also act as arbitrators in proceedings before the Danish Institute of Arbitration, the ICC and ad hoc arbitration tribunals.
 
Furthermore, LETT has specialists in mediation as well as other kinds of structured negotiations for the purpose of reaching a settlement.
